Welcome to Rich Habits. These Terms of Service ("Terms") govern your use of our website and your purchase of products from Rich Habits LLC ("Rich Habits," "we," "us," or "our"). By accessing our website or making a purchase, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our website, placing an order, or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Products and Services

Product Descriptions

We strive to display our products as accurately as possible. However, colors may vary slightly due to monitor settings and printing processes. We reserve the right to modify product specifications without notice.

Custom Products

Custom products are made to your specifications. By submitting a design or approving a mockup, you confirm that:

  • You have the right to use all logos, images, and content
  • The design does not infringe on any third-party rights
  • You accept responsibility for the accuracy of the design

3. Orders and Pricing

Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Pricing

All prices are listed in US dollars unless otherwise specified. Prices are subject to change without notice. We are not responsible for typographical errors in pricing. If an error is discovered, we will notify you and give you the option to proceed at the correct price or cancel your order.

Minimum Order

Custom orders require a minimum of 25 total items. Items can be mixed and matched across products.

4. Payment Terms

  • A 50% deposit is required to begin production on custom orders
  • The remaining balance is due before shipping
  • We accept major credit cards, checks, and ACH transfers
  • Net-30 terms may be available for qualified organizations

5. Shipping and Delivery

Shipping timelines are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other factors outside our control. Risk of loss and title for products pass to you upon delivery to the carrier.

6. Returns and Refunds

Custom Orders

Custom orders are final sale and cannot be returned or refunded. This includes all orders made to your specifications with custom designs, colors, or personalization.

Defects

We guarantee the quality of our products. If you receive defective items (printing errors, fabric defects, wrong sizes shipped), we will replace them at no charge within 40 days of delivery.

Size Exchanges

Size exchanges are available within 14 days of delivery for unworn items with tags attached. Customer pays return shipping. New sizes subject to availability.

7. Intellectual Property

Our Content

All content on our website, including text, graphics, logos, images, and software, is the property of Rich Habits or our licensors and is protected by copyright and trademark laws.

Your Content

By submitting designs, logos, or other content to us, you grant us a non-exclusive license to use, reproduce, and modify that content solely for the purpose of fulfilling your order. You retain ownership of your content.

Portfolio Rights

We may use photographs of completed orders in our portfolio, website, and marketing materials unless you notify us in writing that you do not wish to be featured.

8. User Conduct

You agree not to:

  • Use our website for any unlawful purpose
  • Submit designs containing illegal, offensive, or infringing content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of our website
  • Impersonate any person or entity

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RICH HABITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE OR PURCHASE OF OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Rich Habits, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our website, your purchases, or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Jefferson County, Alabama.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website after any changes constitutes acceptance of the modified Terms.
